What the Labour Code says
Article 52: an employee on a permanent contract is entitled to severance pay after six months of work in the same company, whatever the way they are paid.
Article 53: for each year or fraction of a year of actual work, severance pay is 96 hours of salary for the first five years, 144 hours from the 6th to the 10th year, 192 hours from the 11th to the 15th year and 240 hours beyond 15 years. The contract, the collective agreement or the internal rules may provide more.
Articles 55 to 57: the calculation uses the average salary of the last 52 weeks, including bonuses and benefits in kind (excluding expense refunds), and never below the minimum wage. To turn a monthly salary into an hourly wage, 191 hours per month are used in practice (article 238; 2,288 hours a year under article 184).
Article 41: for an unfair dismissal, the court may order reinstatement or damages based on one and a half months of salary per year or fraction of a year, without exceeding 36 months. They come on top of severance pay and payment in lieu of notice.
Notice (article 43 and decree no. 2-04-469): for an executive, 1 month under one year of service, 2 months from 1 to 5 years and 3 months beyond; for an employee or a worker, 8 days, 1 month and 2 months. If it is not respected, a payment equal to the salary for the period is due (article 51). Serious misconduct removes both notice and severance pay.
Job loss allowance (IPE): paid by the CNSS, subject to contribution periods and registration as a jobseeker. It does not depend on the employer and is not calculated here: check with the CNSS.

Frequently asked questions
How long must I have worked to get severance pay?
Six months in the same company, on a permanent contract (article 52). Below that, only payment in lieu of notice may be due.
Is severance pay due for serious misconduct?
No: serious misconduct removes notice and severance pay. If the employee disputes it and the court rules the dismissal unfair, they can obtain severance pay and damages.
How are incomplete years counted?
Article 53 refers to each year or fraction of a year. In practice the fraction is usually counted pro rata; some count it as a full year. The calculator offers both.
Are damages for unfair dismissal automatic?
No: they are set during conciliation at the labour inspectorate or by the court, within the limit of one and a half months of salary per year and 36 months in total.
